Health Care Reform Bill = Windfall For Retiree Insurers

SO HEALTH CARE REFORM HAS FINALLY PASSED! Yet, missed amongst the clamor surrounding, “political partisanship”, “the funding of abortion” or “the Cadillac tax” there is a significant subsidy that may provide relief to plan sponsors struggling to reign in retiree healthcare costs. This provision, referenced as the “Reinsurance Program”, creates a “reinsurance” subsidy for plan sponsors of retiree health plans providing coverage for pre- Medicare retirees over the age of 55.

 The Medicare Modernization Act of 2003 created an employer subsidy program (“Retiree Drug Subsidy” or “RDS”) for plan sponsors as an incentive to maintain their retiree drug plans in lieu of dropping the coverage and forcing retirees to a Medicare Part D plan.  The Reinsurance Program appears to provide employers a similar incentive. The incentive under this program would be for employer groups to maintain the medical plans for their pre- Medicare eligible retirees in return for a significant subsidy.

 The Reinsurance Program clearly benefits employers and industries that are union-dominated and saddled with rich and expensive retiree medical plans. Ironically, as the health care reform bills have been touched by so many special interests and tainted by the political reality of compromise, one of the remaining provisions, the “Cadillac tax”, may be neutralized by the subsidy (although at print, labor presumably has worked out a deal with the White House to exempt groups with collective bargaining agreements until 2018). The “Cadillac tax”, which imposes a 40% excise tax on plans with premium costs exceeding pre-established “threshold amounts”, would increase plan costs for many of the same plans eligible for the reinsurance subsidy. For plan sponsors with a considerable retiree population the effect is that every dollar of the retiree plan premium subject to the excise tax could be significantly offset by a corresponding subsidy.

 

What are the Potential Savings?

The proposed program would establish a “temporary” Reinsurance Program for employers who provide health insurance coverage to retirees over the age of 55 and who are NOT yet eligible for Medicare. The program would reimburse employers or insurers for 80% of retiree claims between ,000 and ,000.

 For an employer group with 700 employees and 500 retirees that spends ,000,000 a year on health insurance plans, the subsidy could be as much as 0,000, effectively reducing its retiree plan costs by 14.4%.

 

How Will This Reinsurance Program Work?

If we can learn any lessons from the Retiree Drug Subsidy (“RDS”) program, where initially the drug subsidy was to be calculated as a percentage on ALL prescription drug claims incurred by plan sponsors, there will likely be a segment within the government that will push to dilute and reduce the category of “eligible” claims in the final calculation.  The RDS formula was initially relatively simple until there was a bureaucratic decision to create “excluded” drug classes from subsidy eligibility. CMS’ rationale behind this change was to NOT pay subsidy on drugs that were excluded under the government sponsored Part D drug plan formulary. There could be a similar rationale used to create “excluded” medical expenses to align subsidy eligibility with only medical procedures approved and part of the government’s baseline plans as defined within the final bill.

 Moreover, the language within the two bills is unclear as to “who” gets the subsidy.  The Senate bill states “….the program will reimburse employers or insurers” whereas the House bill only references “employers.”  Moreover, the language in both bills state explicitly that “payments from the Reinsurance Program will be used to lower the costs for enrollees in the employer plan”. What can we interpret from this language? Will the employer not be eligible for subsidy? Will insurance carriers be able to create insurance plans for employer groups and keep the subsidy and then lower premium costs just as they do now under Medicare Advantage?

 

How Long Will This Program Last?

The subsidy is “temporary”, as the Bill appropriates only billion to fund this program through January 1, 2014.

Quick math shows that the monies earmarked for this program could run out quickly. The 2006 PEW Center1 Study reported significant un-funded retiree healthcare liabilities for state and local governments alone. State systems are projected to payout .7 billion for “other post employment benefits”. The 30 year retiree healthcare liability was projected to be 1 billion; a conservative estimate since these figures do not include obligations for teachers or local government workers.  The State of California, combined with all local governments within California, was projected to have a billion retiree healthcare bill in 2009. Add to this all the large Taft Hartley plans, independent VEBA plans (i.e. the UAW VEBA) and the remaining large private sector retiree plans, one can see this earmark evaporating in a short period of time.

 This begs the question. How will priority be established if the government agency in charge of managing this program is inundated with applications? Will it be first come, first serve?  Will there be some level of “need” established to assign priority or create qualification?  Or will this program, once Health Care Reform passes, become another entitlement program that is legislated into permanency?

Hello Scott Brown, Goodbye Filibuster-Proof Healthcare Reform

Healthcare reform, which appeared to be inevitable a few short weeks ago, has been dealt a major setback. Yesterday, the state of Massachusetts held a special election to fill the late Ted Kennedy’s Senate seat. In a sad irony for those seeking to change America’s individual health insurance system, the staunch reform advocate was replaced not by Democrat Martha Coakley, but by a Republican, Scott Brown. Brown largely campaigned on his opposition to health care.

Independent voters have soured on the seemingly endless debates over healthcare reform. The economy, including a 10% unemployment rate, have been their primary concern. Many Democrats believe that healthcare reform is closely related to jobs–they feel that small businesses, which create the majority of jobs in the United States, are more likely to be launched if potential entrepreneurs no longer have to worry about finding affordable self employed health insurance. However, they have failed to convince the voting public of those potential benefits.

The results mean that the Democratic party has lost its filibuster-proof majority in the Senate. With 41 votes, Republicans can now block the healthcare bill. Majority Leader Harry Reid has vowed that he will not delay Brown’s swearing-in; such a move would have potentially catastrophic political consequences. For Democrats up for re-election this year, the climate is already hostile. The White House is understandably worried about this near-fatal blow to the centerpiece of President Obama’s domestic agenda.

Staffers have pointed fingers at Coakley for running an incompetent campaign, which featured several notable gaffes and relatively little on-the-ground action. On the other hand, Coakley employees have blamed the national party and White House for providing only last-minute support (Obama made one stump speech on her behalf) and the delay in passing health insurance reform that has allowed the public to become ever more impatient. Several weeks ago, Coakley had a significant lead in the polls, but it was largely squandered as congressional committees continued to coincide their bills with seemingly little progress. Both sides certainly played a role in the loss.

Massachusetts has more experience with medical insurance reform than most states. For several years, the state has had an individual health insurance mandate. The mandate, which is somewhat similar to the current Senate proposal, requires that all residents either buy health insurance or pay a fine. It also offers subsidies to help individuals and families making under a certain annual income buy coverage. Medicaid and Medicare insurance are also available. Although it has resulted in a significant reduction in the percentage of uninsured residents, costs have continued to rise under Massachusetts’ healthcare reform. (While the Senate has proposed further cost control measures beyond those used in Massachusetts, liberals in the House have long opposed some of them–such as the tax on high-cost insurance plans, which would hit mainly Democratic union voters hardest.) It is possible that personal experience colored their vote.

Exit polling bears out this notion; the polls show that nearly half of Massachusetts voters were primarily concerned with healthcare reform, as opposed to Obama’s general agenda. In fact, the majority of Massachusetts voters approved of his performance, both in general and on other specific issues (e.g. the war in Afghanistan and the economy). Thirty-nine percent of voters claim that Brown’s opposition to health insurance reform was behind their vote. Coakley’s lack of personal appeal and perceived negative campaign tactics also made an impact.

In what many have considered the epitome of a blue state, such emotions should be heeded. Prominent Republican politicians and spokespersons have taken the vote as further evidence that individual health insurance reform should be scrapped entirely. However, doing so would be even more humiliating for Democrats, whom have already spent so much political capital on the measure. The most likely option for Democrats is to convince the House of Representatives to vote for the Senate bill as-is, allowing it to reach Obama’s desk for him to sign it into law. Such a move is legal and would require no new vote on the measure; temporarily appointed replacement James T. Kirk’s yes vote would stand. However, doing so runs the risk of stoking further public anger, due to the perception that they are going against the public’s wishes. In addition, the House has presented many of their own adjustments to the bill, which would be thrown out in such an arrangement.

House progressives, whom already feel as if they have given up a lot in the negotiations (such as the public option), may not want to vote for the less expansive Senate bill. They may be convinced to give in at the prospect of passing legislation to provide low cost medical insurance to millions of uninsured Americans, especially since a new vote with Brown seated may likely kill the bill entirely. Meanwhile, some centrist and conservative Democrats in the House of Representatives are unhappy with what they consider as weak restrictions on abortion coverage in subsidized individual health insurance policies. Some Democratic representatives or senators up for re-election may also switch sides and vote against the legislation in any potential re-vote. Doing so may hurt them with the electorate even more, because it will paint them as flip-floppers.

Premium tax would hike health-insurance costs

Why? Because Congress wants to levy a .7 billion premium tax on all private health plans each year for the next decade to pay for reform.

That’s a billion tax.

Health plans will have no choice but to pass these costs on to the consumer. This tax will make it tougher for families to afford coverage, increase the difficulty for small-business owners trying hard to insure workers, and stifle job creation.

In Florida, small businesses are the bedrock of our economy. This tax will hit our economy especially hard. It’s just not what families and small businesses need as they dig their way out of a severe recession.

The Congressional Budget Office evaluated this tax and found it will lead to “higher premiums for private coverage.” The nonpartisan CBO estimated that premiums for individual coverage could rise by as much as 13 percent.

This tax also might be disruptive to policyholders, because it could damage the ability of health plans to deliver all the benefits that members expect.

That’s because Congress is ready to impose this health-insurance tax in 2010. That’s after families have already signed up for coverage for next year, and after small businesses have already negotiated coverage contracts.

The result? Health plans may not receive enough premium to cover the costs of the massive tax, and benefits might suffer.

Unfortunately, health plans have been demonized in the pursuit of reform. But in reality, it’s not true to claim that health plans make a lot of money; their profit margins are actually pretty small.

In 2008, private health plans made .61 billion in total profits nationally, according to Forbes magazine. The industry’s profit margin was just 2.2 percent, ranking health plans 35th out of 53 industries in terms of profitability.

As the president and CEO of SantaFe HealthCare — the parent company of AvMed Health Plans — I am truly concerned by this proposed tax. As one of Florida’s oldest and largest nonprofit health plans, AvMed reinvests its earnings each year to continually improve on the benefits and services it offers to members in Orlando and elsewhere.

Obviously, a health-insurance tax that wipes out most of our annual earnings is counterproductive to our mission. Surely, congressional leaders must grasp that this tax doesn’t make sense.

There are better ways to pay for the systemic health-care reform that AvMed and other health plans support.

Instead of taxing health insurance, Congress should focus on the underlying costs of medical care. We can achieve huge cost savings by ending unnecessary treatments and services, rooting out rampant fraud and ending frivolous medical lawsuits filed by trial lawyers.

Health reform shouldn’t hurt Florida’s families and small businesses. It shouldn’t hamper the ability of health plans to provide benefits.

Check that the online program offers clinical on-the-field instruction on top of the online, didactic instruction. Learning nursing and other clinical specialties require hands-on experience and are as crucial, if not more so, than textbook instruction. There are many core curriculum courses in nursing that can be learned online through studying lessons but courses that have clinical requirements should be taught and experienced on the field. Be very skeptical about an online school that does not require field experience. Most probably, this online school does not meet the state licensing requirements.

Payment scheme

Watch out for online schools or distance programs that require you to pay the whole amount of your tuition up front in lump sum. Distance schools are susceptible to high dropout rates and these schools are aware of this fact. Some of these dubious schools take advantage of this knowledge and get students to pay for the whole tuition fee and then refuse a refund when after one course the student realizes that the program is not for him or her.
